Dina’s Docket: Weekly Trump Recap (2/9/24)

Another week, another round of updates in the many ongoing Trump trials. (The nonpartisan nonprofit JUST SECURITY has a fabulous master calendar of key dates in Trump’s trials.)

This hugely significant week for Trump legal news began with the D.C. Court of Appeals saying that Trump does not have absolute immunity for criminal prosecution and that case can proceed. He's going to be appealing it. Will the Supreme Court take it? I could see them not because their opinion was so thorough, but this is a case of first impression.

They've never decided whether or not a president could be prosecuted after leaving office. So in that case, they might take it. The strongest arguments were not only using Trump's own words against him; he explained to Congress that they shouldn't convict him because courts were the proper place when he left office, and they used those words against him in this opinion. Now, that D.C. court has ruled not only that he can be sued civilly, but he could be sued criminally despite the fact he was president at the time of January 6.

Then we moved on to the Supreme Court oral arguments that were deciding whether or not he could remain on the ballot in Colorado despite Colorado saying he committed insurrection — and so was not qualified under the Constitution. None of the justices wanted to give a state this power. When we do see that ruling, we're most likely going to see they're going to allow him on the ballot.
